Your Rights as a California Resident

If you are a California resident, you have the right to:

  • Request access to the personal information we have about you

  • Request a copy of that information

  • Request that your information be corrected if it is inaccurate

  • Request that your information be deleted, subject to certain legal exceptions

  • Request information about how your data is collected, used, and shared

  • Opt out of the sale or sharing of your personal information (we do not sell or share personal information)

How We Protect Your Health Information (HIPAA Notice of Privacy Practices)

This section describes how health information about you may be used and shared, and how you can access it. Please review it carefully.

As a healthcare provider, Tonalli Therapy is required by the Health Insurance Portability and Accountability Act (HIPAA) and the California Medical Information Act (CMIA) to keep your Protected Health Information (PHI) confidential, to give you this notice of our practices, and to follow the terms of the notice currently in effect.

How we may use and share your information

Without your specific authorization, we may use or share your health information for:

  • Treatment. Providing therapy services to you, and coordinating or consulting with other healthcare providers involved in your care when appropriate.

  • Payment. Verifying insurance benefits and submitting claims, when applicable.

  • Healthcare operations. Internal activities like quality review, training, supervision of associate clinicians, and case consultation. Identifying details are limited to the minimum necessary.

As required by law. Including the situations described in "Limits of Confidentiality in Therapy" below.

Uses requiring your written permission

For any use or disclosure not described above or otherwise permitted by law, we will ask for your written authorization first. You may revoke that authorization in writing at any time, except where action has already been taken in reliance on it.

Your rights regarding your health information

Under HIPAA and California law, you have the right to:

  • Access your therapy records and receive a copy, with limited exceptions under California law for psychotherapy notes and information that could cause harm

  • Request amendment of your records if you believe something is inaccurate

  • Request an accounting of certain disclosures we have made

  • Request restrictions on certain uses and disclosures (we will consider these requests but are not always required to agree)

  • Request confidential communications by alternative means or at alternative locations

  • Receive a paper copy of this notice on request

  • File a complaint if you believe your privacy rights have been violated, with us directly and/or with the U.S. Department of Health and Human Services, Office for Civil Rights

We will not retaliate against you for filing a complaint.

Our duties

We are required by law to maintain the privacy of your health information, to provide this notice, and to follow its terms. We reserve the right to update this notice; the current version will always be available on this page and in our office.

Limits of Confidentiality in Therapy

Confidentiality is one of the most important parts of therapy, and we take it seriously. There are, however, specific situations where California and federal law require us to share information without your authorization. We are open about these limits at the start of treatment, and they include:

  • Suspected abuse or neglect of a child, dependent adult, or elder

  • Situations involving a serious and imminent threat of harm to yourself or someone else

  • Court orders, subpoenas, or other legal proceedings, where applicable law requires or permits disclosure

  • Reporting required by California law (Board of Behavioral Sciences, public health, etc.)

  • Coroner or medical examiner purposes following a death

If any of these situations arise, we work to share only the minimum information legally required.

Telehealth Services

Tonalli Therapy offers telehealth (video) sessions to clients located in California, and in other states where our clinicians are licensed or otherwise authorized to practice. We use HIPAA-compliant video conferencing for these sessions.

A few things to know about telehealth:

  • Telehealth is not appropriate for every situation. Your therapist will discuss with you whether it's a good fit for your needs.

  • The same confidentiality protections that apply to in-person therapy apply to telehealth.

  • Technology occasionally fails. Your therapist will discuss backup communication plans with you so we have a way to reconnect if a session is interrupted.

  • Telehealth is not appropriate for crises or emergencies — please see the next section.

  • You may withdraw consent for telehealth at any time and request in-person services, subject to availability.

We review specific telehealth consent with each client at the start of treatment.

Emergency & Crisis Support

This website is not intended for urgent or crisis situations, and we are not available 24/7 by phone, email, or contact form.

If you are experiencing an emergency or need immediate support, please:

  • Call 911

  • Call or text 988 (Suicide & Crisis Lifeline)

  • Go to your nearest emergency room

Local Bay Area resources are also available; we are happy to share these with current clients as part of treatment.

Good Faith Estimate (No Surprises Act)

Under federal law, if you are uninsured or choose not to use your insurance, you have the right to receive a "Good Faith Estimate" of the expected cost of therapy services.

  • You have the right to receive a Good Faith Estimate of the total expected cost of any non-emergency healthcare service.

  • We will provide you with an estimate before your scheduled service, or at any time on request.

  • If you receive a bill that is at least $400 more than your Good Faith Estimate for that service, you have the right to dispute the bill.

  • Please keep a copy of your Good Faith Estimate.
